1. THE PARTIES
1.1 Istanbul Medipol University Health Sciences and Technologies Research Institute (hereinafter referred to as SABITA)
1.2 The person and/or organization requesting a service from SABITA (hereinafter referred to as the Customer)
2. THE SCOPE
2.1 This document contains the administrative, financial and legal terms and conditions between SABITA and the customer. All correspondence and annexes between SABITA and the customer during the process from the service application to its finalization are considered as a part of this specification.
3. THE RESPONSIBILITIES OF SABITA
3.1 SABITA is responsible for meeting the service requests of the customer within its own means and within the framework of the principle of confidentiality.
3.2 The declared service times are estimated and SABITA cannot be held responsible for delays due to unprecedented reasons. In case of deviation from the promised conditions, the customer will be notified in writing or verbally.
3.3 Provided that the laboratory conditions are available, and permission is obtained from the authorities, the customer may monitor the service under the supervision of laboratory personnel.
3.4 After the completion of the service, the samples are stored under appropriate conditions for ten (10) working days, after which they are sent to waste. In case of a request for the return of the remaining samples from the service use, it will be returned at the customer’s expense.
3.5 In case of objections to the analysis services, the maximum period for objection is limited to the retention period of the sample. If the result is found to be different from the previous one, no fee is charged for additional procedures.
3.6 SABITA is responsible for the confidentiality and security of customer information. The results are sent to the contact addresses specified in the request form or request letters. SABITA may share customer information with legal authorities and/or third party institutions and persons without informing the customer when required by law.
4. THE RESPONSIBILITIES OF THE CUSTOMER
4.1. Customers who wish to benefit from SABITA’s services must first fill in the relevant Service Request Form in order for their application to be accepted and fully express the services requested to be performed in the sample.
4.2. By filling out the service request form, the customer accepts that the customer declares the harmful effects of the sample sent to the service (if any) on human and environmental health, and that he / she will be responsible for any nonconformities that may occur if he / she does not.
4.3. The customer must deposit the service usage fee of the samples to Istanbul Medipol University bank account after the receipt of the letter including the acceptance of the service request and notification of the service fee. After the receipt of the payment is sent to SABITA, the service start process is commenced.
4.4. For appointment services, the customer undertakes to be ready at the specified laboratory at the time of appointment, to notify at least twenty-four (24) hours in advance in cases where he/she cannot be ready due to compelling reasons, and otherwise to pay the service fee.
4.5 The transportation, packaging and storage of the sample until its admission to SABITA is in the customer’s responsibility. SABITA cannot be held responsible for any negativities that may occur in the analysis results due to such factors.
4.6. The information provided regarding the sample is based on the customer’s declaration. The customer agrees to pay all necessary fees for the elimination of a malfunction that may occur in the device due to incorrect or incomplete specification of the sample content.
4.7. In case of objection to the result of the analysis and request for repetition of the service, if the objection is unfair, the cost of the additional work shall be borne by the customer.
4.8. If the customer uses the analysis results in a scientific publication, it must be stated in the publication that Istanbul Medipol University SABITA is the institution where these services are performed.
4.9. In order for the analysis results to be used in advertisements by mentioning the name of Istanbul Medipol University and/or SABITA, the customer must obtain written permission from SABITA management.
4.10. The content, duration and information of the projects carried out within the scope of EU, BAP, SANTEZ, KOSGEB, TUBITAK, etc. are not known and followed up by SABITA. The responsibility that may arise from the non-compliance of the services requested to SABITA with the conditions of the project whose number is specified belongs to the project manager and the customer.
5. DISPUTE SETTLEMENT
5.1 SABITA examines the likes, suggestions, complaints and objections received from customers as soon as possible, objectively, fairly and in accordance with legal requirements, with a customer-oriented approach and provides feedback.
5.2 In disputes arising after the signing of this agreement, mutual agreement is sought first. If the parties cannot mutually agree, Istanbul courts and enforcement offices are authorized.
This agreement has been prepared in three pages and has been read, understood and accepted by the customer.
